Die Dauer eines Genehmigungsverfahrens nach Bundesimmissionsschutzgesetz von dem Beginn der innerbetrieblichen Antragserstellung bis zu dem Zeitpunkt, in dem die erteilte Genehmigung für Errichtung Betrieb rechtskräftig wird, wird in den drei Phasen - Vorbereitungsphase, Genehmigungsphase und Einspruchsphase - untersucht. Der Ist- Analyse der Dauer ist eine Soll-Analyse eines idealen Genehmigungsverfahrens bei gege- benem Stand der Gesetze gegenübergestellt. Der anschließende Soll-1st-Vergleich zeigt, daß eine Lücke von 29 Monaten zwischen der Dauer des dargestellten Beispiel-Genehmi- gungsverfahrens (47 Monate) und dem Idealfall einer Genehmigung (18 Monate) zu überbrücken ist. Dieser Artikel schließt mit Vorschlägen, wie das Unternehmen durch eine Verbesserung der Aufbauorganisation, insbesondere betreffend die den Genehmi- gungsantrag erstellenden und die Genehmigung begleitenden Organisationseinheiten im Unternehmen, das Genehmigungsverfahren beschleunigen kann. Summary The duration of the licensing procedure for an industrial plant from its date of kick off for approval within the company until the point in time when the notice of approval becomes legally effective is analysed in three phases: preparation phase, licensing phase and objection phase. The resulting analysis of the actual duration is compared with an analysis of the ideal dura ti on given the current legal requirements. The target-perfor- mance comparison shows a gap of 29 months between the actually performed duration (47 months) and the minimum possible target duration (18 months). The difference is due to problems within the company, within the public authority and also roots in their relationship with each other.
